Facts: 1) Fair Isaac has a trademark for "FICO" in the Niche of Credit Scoring and Reporting. 2) Fair Isaac scores Credit with FICO. Lending is a different Niche. 3) LowFicoHomeLoans.com helps people damaged by Low Fico Scores get a loan. 4) LowFicoHomeLoans.com does not offer Credit Scores or Reporting in competition. 5) LowFicoHomeLoans.com has links to Fair Isaac's websites and explains their trademark. 6) LowFicoHomeLoans.com was offered last year for $200, and Fair Isaac refused. 7) Fair Isaac initiated arbitration proceedings to get LowFicoHomeLoans.com free. 8) The National Arbitration Forum refused to consider Federal Law, ruled for Fair Isaac. 9) The National Arbitration Forum typically rules in this manner for big companies. |
Trademark Law has Changed:
1) Initial Trademark Law (the Lanham Act) didn't encompass the Internet, so
2) 1998 - Congress legislated to stop Domain Name Hijacking.
3) 2006 - Congress gives Trademark Enforcement more teeth, but only within the Niche the Trademark Services are Offered.
4) When you buy a Domain Name, you are forced by ICANN to arbitrate.
5) The Arbitrators don't recognize or even consider Federal US Law.
6) Fair Isaac refused our offer to sell LowFicoHomeLoans.com for $200
7) Fair Isaac sued in Arbitration and won.
8) Fair Isaac ignored Federal Law in forced arbitation.
9) To contest the Arbitration Decision against us, we are fighting in US Courts.
10) Help is requested to set precedent against Fair Isaac and other big predators
